Appeal Court Orders New Hearing in Kano Emirate Dispute, Slams Unfair Trial

The Court of Appeal in Abuja has mandated a fresh hearing in the ongoing legal dispute over the Kano Emirate, which involves Alhaji Nasir Ado Bayero.
In a ruling delivered on Friday, the appellate court concluded that Bayero was denied a fair hearing due to the improper conduct of proceedings by the Kano High Court.
Justice Mohammed Mustapha, who delivered the lead judgment, stated that Bayero was not properly notified of the hearing, which prevented him from presenting his case. The court emphasized that all judicial processes must be fair, ensuring that all parties have an equal opportunity to be heard. The judge noted that the handling of Bayero’s case by the Kano High Court represented a miscarriage of justice.
The Court of Appeal ruled that Bayero should have been given a hearing notice to allow him to voice his objections before the court made its ruling, which was conducted under questionable circumstances.
As a result, the court directed that the case be sent back to the Chief Judge of the Kano State High Court for reassignment to a different judge for prompt resolution.
Justice Mustapha also decided not to impose any costs on the respondents in Bayero’s appeal.
