Court Clears Abba Kyari, Dismisses Asset Declaration Charges

The Federal High Court in Abuja has acquitted suspended Deputy Commissioner of Police Abba Kyari of a 23-count charge bordering on alleged non-declaration of assets.

 

Delivering judgment on Thursday, Justice James Omotosho ruled that the National Drug Law Enforcement Agency (NDLEA) failed to substantiate the allegations brought against Kyari and his two brothers, who were accused of submitting false affidavits to conceal the source of certain properties.

The court held that the prosecution did not present reliable evidence linking Kyari to landed assets in Fountain Estate, Kasana, reportedly associated with Ramatu Kyari, nor to properties located on Linda Choko Road in Asokoro and in Maiduguri, Borno State.

Justice Omotosho noted that proof of land ownership may be established through title documents, acts of possession, traditional history, or related connections, but found that none of these were convincingly demonstrated by the prosecution.

The judge further observed that Kyari’s claim that the Maiduguri properties were inherited from his late father was not successfully challenged in court. He also ruled that the charge of conspiracy filed against Kyari’s brothers was not proven.

Consequently, the court discharged and acquitted all the defendants on every count.
