Court Dismisses NGO’s Case Against NUPRC, Hits Back with Fine
Abuja, Nigeria — July 20, 2025
In a clear message against misuse of judicial processes, the Federal High Court in Abuja has dismissed a suit filed by a non-governmental organization against the Nigerian Upstream Petroleum Regulatory Commission (NUPRC) and its Chief Executive, Gbenga Komolafe, describing the action as frivolous and lacking merit.
The court, presided over by Justice A.R. Mohammed, not only threw out the case but also imposed a financial penalty on the NGO, stating that the organization had wasted the court’s time with baseless allegations aimed at maligning public officials and disrupting regulatory functions.
The suit, filed earlier this year, accused the NUPRC of regulatory overreach and alleged misconduct on the part of Komolafe in the execution of his duties. However, during proceedings, the court found that the claims were unsupported by credible evidence and appeared to be driven more by personal or political motives than by genuine public interest.
“This court will not allow its sacred halls to be turned into a playground for reckless allegations and unsubstantiated claims,” Justice Mohammed stated in his ruling. “Public interest litigation is a powerful tool in the pursuit of justice, but when abused, it becomes a dangerous weapon against integrity and due process.”
The judge ordered the NGO to pay a fine of ₦2 million as a deterrent to future abuse of the court system. He also praised the legal team representing NUPRC and Mr. Komolafe for their professionalism and clarity in dismantling the claims presented.
Reacting to the judgment, legal analysts said the ruling underscores the need for greater accountability among advocacy groups and civil organizations that engage in litigation.
“This judgment sends a strong signal that the judiciary won’t tolerate the use of lawsuits as a smear campaign or for media drama,” said Barrister Ifeanyi Okoro, a constitutional lawyer. “It reinforces the importance of presenting solid facts, especially when accusing public servants.”
Gbenga Komolafe, who was appointed as the Chief Executive of NUPRC in 2021, has been at the forefront of reforms aimed at improving transparency and efficiency in Nigeria’s upstream petroleum sector. Supporters say the dismissed lawsuit was a failed attempt to derail these efforts.
As the commission continues its regulatory role in overseeing Nigeria’s vital oil and gas sector, this legal victory is expected to strengthen its resolve and protect its leadership from distraction by ungrounded legal c
