The leadership of the Osun State Chapter of the Association of Local Governments of Nigeria (ALGON), on Tuesday called for calm following the judgment of the Federal High Court sitting in Osogbo, the state capital on Monday.
Osun ALGON vowed to exhaust all possible legal means to seek a redress at the superior court over the verdict of Justice Adefunmilola Demi-Ajay who dismissed the suit.
Recall that Osun Council Executives, elected under the platform of the All Progressives Congress, APC had approached Osogbo Federal High Court to determine their tenure in Suit No FHC/OS/CS/147/2025 filed by the reinstated Chairmen and Councilors elected on 15th October, 2022 in Osun State having being “obnoxiously ordered” by the state government to vacate council but reinstated by the Court of Appeal in February 10th, 2025.
The suit was commenced in September, 2025 and following a number of Appeals arising from the interlocutory rulings, the Court of Appeal in Abuja sat on the matter on 3rd June, 2026 and adjourned the hearing of the appeals to 28th September, 2026.
Notwithstanding the fact that the Court of Appeal has become seised of the matter and a motion for staying further proceedings by the Lower court in the matter is pending at the Court of Appeal, the Judge went ahead and proceeded to judgment on 15th June, 2026 where the suit was dismissed.
The Judge ruled that the tenure of office of the reinstated elected officers of the local government councils ended in October, 2025. The implication is that the purported elections conducted by the Osun State Independent Electoral Commission on 22nd February, 2025 and the alleged swearing in of the people as elected officers on 23rd February, 2025 became a nullity having held that the tenure of office of the Plaintiffs subsisted till October, 2025.
Meanwhile, the Council Chairmen and Councillors, in a statement personally signed by the ALGON Chairman, Hon. Samuel Idowu Abiodun and made available to newsmen in Osogbo on Tuesday, dismissed the insinuations being sponsored by the state government over the verdict noting that all the elected Council Chairmen and Councillors remained in office until the matter is finally decided by the superior courts.
According to the ALGON Chairman, the reinstated Council Officers shall put to test the judgment at the appropriate venue and until such constitutional rights are exhaustively exercised, the reinstated Chairmen and Councilors will continue to discharge their constitutional duties in their respective offices.
Hon. Abiodun urged members of the public to be wary of the usual misleading information being peddled by the Osun State Government over the void elections and swearing-in purportedly done in February, 2025 clearing that the verdict had further nullified the purported “shenanigan and political charade” called local government election under the incumbent government.
Osun ALGON implored the law enforcement agents to swing into action so as to further strengthen the security and caution those illegally parading themselves as Council Officers and members of the deregistered Accord who are allegedly trying to breach the rule of law by looking for means to create crises over the matter.
