Malami, Son’s Trial Over Terrorism Financing, Firearms Adjourned to April 15

Abuja, Nigeria – The Federal High Court in Abuja has adjourned the trial of former Attorney-General of the Federation, Abubakar Malami, and his son, Abdulaziz, over allegations of terrorism financing and unlawful possession of firearms. The matter is now slated for April 15 and 16.

The defendants appeared before Justice Joyce Abdulmalik on Tuesday when the prosecution requested additional time to prepare. Mr. Akinlolu Kehinde, SAN, who recently took over the prosecution, told the court he needed time to confer with witnesses.

“I received instructions to take over this case on Monday and require time to interface with witnesses,” Kehinde said. Counsel to the defendants, Mr. Shuaibu Arua, SAN, did not object to the adjournment. Justice Abdulmalik subsequently granted the request.

The Department of State Services (DSS) had arraigned Malami and his son on a five-count charge, accusing Malami of failing to prosecute suspected terrorism financiers during his tenure as Attorney-General. They were also accused of illegally storing firearms at their residence in Gesse Phase II Area, Birnin Kebbi Local Government Area of Kebbi State.

Specifically, the first count alleges that Malami knowingly abetted terrorism financing by refusing to prosecute certain cases, contrary to Section 26(2) of the Terrorism (Prevention and Prohibition) Act, 2022. Counts two through five accuse both father and son of possession of a Sturm Magnum 17-0101 firearm, 16 live cartridges, and 27 expended cartridges, in violation of the Terrorism Act and the Firearms Act, 2004.

The DSS handed the case over to the Office of the Attorney-General of the Federation on March 4, ahead of the scheduled commencement of full hearing.
