Nnamdi Kanu Accuses Justice Nyako of Judicial Bias, Seeks NJC Action

Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), has filed a formal petition against Justice Binta Nyako of the Federal High Court in Abuja, accusing her of judicial bias and misconduct in handling his ongoing trial. The petition, dated January 13, 2024, was submitted to the Chief Justice of Nigeria, who also chairs the National Judicial Council (NJC).

Kanu claims that Justice Nyako’s actions throughout his trial have caused him significant and ongoing harm, including unjust deprivation of his freedom. He has been facing seven terrorism charges filed by the Federal Government, with Justice Nyako presiding over the case.
In the petition, Kanu, supported by an affidavit from his brother, Prince Emmanuel Kanu, outlines several allegations of misconduct, particularly the judge’s refusal to grant him bail despite a ruling by the Supreme Court. He argues that this refusal constitutes a breach of the Constitution.
Kanu stated, “Justice Binta Murtala-Nyako, who is currently presiding over Court 2 of the Federal High Court in Abuja, has engaged in judicial fraud by failing to comply with the Constitution and established legal standards. Her refusal to reinstate my bail, in defiance of the Supreme Court’s decision, violates Section 287(1) of the Constitution, which mandates that all authorities and courts comply with Supreme Court rulings.”
Kanu also criticized Justice Nyako for disregarding constitutional principles and the rule of law, asserting that her actions have violated his fundamental rights. The petition concluded by urging the NJC to take disciplinary action against the judge in accordance with the relevant rules governing judicial
conduct.
