How Two Courts Issue Conflicting Orders on Emir Sanusi’s Eviction from Palace
Two courts in Kano have issued opposing orders regarding the eviction of the reinstated Emir of Kano, Muhammadu Sanusi II, from the Emir’s Palace.
Justice S.A. Amobeda of the Federal High Court in Kano has ordered the eviction of Emir Sanusi from the palace. This order includes a directive for the police to ensure that all rights and privileges due to Aminu Bayero, the 15th Fulani Emir of Kano, are upheld.
Simultaneously, another court in Kano has issued an order preventing the police, the State Security Service, and the Nigerian Army from evicting, harassing, or arresting Emir Sanusi. This conflicting order was given by Justice Amina Aliyu of the Kano State High Court.
Justice Amobeda’s order emphasizes that it was made to maintain justice and peace in Kano. The interim injunction restrains the respondents and their agents from taking any actions that would infringe on Bayero’s rights or deny him access to his official residence at the Emir’s Palace, Kofar Kudu, until the originating motion is heard and decided. The case is adjourned to June 4 for a hearing.
Conversely, Justice Aliyu’s order, granted upon an ex parte application by counsel Bashir Yusuf, prevents any harassment, intimidation, or invasion of Emir Sanusi’s personal or official residence. This includes a prohibition against seizing symbols of the Emir’s authority such as the Royal Hat of Dabo and the Emir’s sword. The order also maintains that no further actions should be taken that could interfere with Emir Sanusi’s rights or functions pending the hearing of the motion on notice, which is adjourned to June 13.
These conflicting orders create a legal impasse regarding the status and residence of Emir Sanusi II and Aminu Bayero, highlighting the complexity of the situation.
